General Terms and Conditions of ROIA MOTO OG

1. Scope

These Terms apply to all orders placed by consumers through our online shop roiamoto.com. A consumer is any person entering into a contract for purposes that are predominantly outside their trade, business or profession. Deviating terms of the customer apply only if we have expressly agreed to them.

3. Ordering and formation of contract

(1) The presentation of products in the shop is not yet a binding offer.

(2) You add products to your cart and proceed to checkout. There you enter your contact and delivery details and choose shipping and payment. Before submitting, you see a summary of your order including the total price. You can correct input errors at any step using the back function or the edit links. By clicking the final order button, you submit a binding offer.

(3) We confirm receipt of your order immediately by email. With this order confirmation we accept your offer and the contract is concluded.

(4) We store the contract text. You receive the order details with the order confirmation email; these Terms are available on our website at any time and can be saved or printed. Contract languages are German and English.

4. Prices, duties and payment

(1) All prices are in euros. For deliveries within the EU they include statutory VAT. Shipping costs are shown separately in the cart and at checkout.

(2) For deliveries outside the EU, customs duties, import taxes and carrier fees may apply. These are not charged by us and are payable by the recipient. Please check with your customs authority before ordering.

(3) You can pay with the payment methods shown at checkout, currently in particular credit and debit card, Apple Pay, Google Pay, eps transfer, Revolut Pay, Klarna and bank transfer. Payment is due when the order is placed.

5. Delivery

(1) We usually ship within 1 to 3 business days after receipt of payment. Estimated delivery times per country are listed on our “Delivery Time” page.

(2) The risk of loss or damage passes to you only when the goods are delivered to you or to a third party designated by you who is not the carrier.

6. Retention of title

The goods remain our property until paid in full.

7. Right of withdrawal for consumers

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period will expire after fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. If you ordered multiple goods in one order and they are delivered separately, the period expires fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

To exercise the right of withdrawal, you must inform us (ROIA MOTO OG, Solothurner Strasse 31/Top 3, 6300 Wörgl, Austria, phone +43 664 9208544, email office@roiamoto.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. You can also withdraw using the “Withdraw from contract” function at the bottom of every page of our online shop; in that case we will send you an acknowledgement of receipt of your withdrawal by email without delay. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to ROIA MOTO OG, Brixentaler Strasse 65, 6300 Wörgl, Austria, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

8. Voluntary return policy

In addition to the statutory right of withdrawal, you may return goods within 30 days of receipt if they are unused and in their original packaging. Please register the return in advance at office@roiamoto.com. Your statutory right of withdrawal and your statutory warranty rights remain unaffected.

9. Statutory warranty (legal guarantee)

(1) The statutory warranty applies. The period is two years from delivery. If a defect appears within one year of delivery, it is presumed to have existed at delivery. If you choose repair, the warranty period is extended once by one year as provided by law.

(2) Please report defects to office@roiamoto.com, ideally with photos and your order number. For justified warranty claims we bear the shipping costs.

(3) Normal wear from use, and damage that only arises after delivery through use other than intended, improper storage, accidents or modifications to the product, are not defects.

10. Intended use and safety instructions

(1) Our products are intended for private use by motorcyclists. Specific limits and safety instructions apply to individual products as stated in the product description and the enclosed instructions. This applies in particular to the Trail Jack: it is an emergency tool for briefly lifting the front or rear wheel for a roadside repair, for motorcycles up to 250 kg ready to ride and a maximum direct load of 200 kg. It does not replace a workshop lift or paddock stand.

(2) Please read the safety instructions before first use and inspect the product for damage before every use. Not intended are in particular motorsport and competitions, continuous commercial use, modifications to the product and exceeding the stated load limits.

(3) Damage caused by use other than intended, by disregarding the safety instructions or by modifications to the product does not constitute a defect. Your statutory rights for defects that existed at delivery and claims under product liability law remain unaffected.

11. Liability

(1) We are liable without limitation for injury to life, body or health, for damage caused intentionally or by gross negligence, and under product liability law.

(2) For property damage and financial loss caused by slight negligence, we are liable only if we breach an obligation whose fulfilment is essential for performing the contract and on which you may rely, such as delivering goods free of defects. In that case, liability is limited to the foreseeable damage typical for this type of contract.

(3) Your statutory warranty rights remain unaffected. Paragraphs 1 and 2 also apply to our employees and agents.

(4) We do not pay punitive or exemplary damages.

12. Force majeure

If we cannot deliver on time due to events beyond our control (such as natural events, strikes, government action, or carrier or customs disruptions), the delivery period is extended by the duration of the disruption. We will inform you promptly. If the disruption lasts longer than four weeks, either party may withdraw from the contract; any payments made will be refunded without delay.

13. Gift cards

Gift cards have no expiry date and can be redeemed in the online shop. They cannot be exchanged for cash; any remaining balance is retained.

15. Complaints and dispute resolution

Please send complaints to office@roiamoto.com. If we cannot reach an agreement in a dispute, we will inform you about the competent alternative dispute resolution bodies and whether we will take part in such a procedure.

16. Governing law and jurisdiction

(1) These Terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules. This choice of law does not deprive consumers of the protection of the mandatory provisions of the law of the country in which they have their habitual residence.

(2) For claims against consumers who live, are habitually resident or employed in Austria, the court of that place has jurisdiction. Consumers residing in the EU may also sue us at their place of residence. Otherwise the competent court in Innsbruck, Austria, has jurisdiction, unless a mandatory place of jurisdiction for the consumer applies.

17. Trademarks and model names

All brand, manufacturer and model names mentioned on this website (e.g. of motorcycle manufacturers) are the property of their respective owners. They are used solely to indicate which vehicles our products are intended for or compatible with. ROIA MOTO OG is not affiliated with, authorized or sponsored by these manufacturers. Our products are not original parts or accessories of the respective vehicle manufacturers.

18. Final provisions

These Terms are available in German and English; both versions have the same content. If any provision is invalid, the rest of the contract remains valid.
